A Home Depot contractor (ARS Network) sold, modified and hooked up a new heat pump HVAC system on the wrong breaker, wire and heat strip (see inspection report)!  They also refused us insurance by not sending an inspector for 143 days!  Home Depot has ignored written complaints from the Fire Marshall, DBPRCode Enforcement and the Florida Attorney General!  Heck, we even emailed the top executives at Home Depot.  Worse!  We are NOT the only Home Depot victims.  Have a look at these 1000+ American Residential Services (ARS) Yelp complaints!

Negligence is the failure to use the level of care and caution that an ordinary person would use in similar circumstances.  Gross negligence is the deliberate and reckless disregard for the safety and reasonable treatment of others.  Home Depot has strong-armed us for 250+ days!

Ashley Moody Florida Attorney General Complaint

Will Home Depot Fix Their Fraudulent Install If The Attorney General Gets Involved?

Reaching Out To The Florida Attorney General:

Today on day 211, we reached out to the Attorney General Of Florida, Ashley Moody!  We have already reached out to Code Enforcement (got a report), to the Fire Marshall and to the DBPR without even a response!  A Veterans life is at risk and these Florida State Organizations have done nothing to protect him!

Paydirt: Attorney General Ashley Moody Gets Involved!

In less than 24 hours, the attorney general got back to me!  I/we are completely shocked since we still have not heard from our case manager at the DBPR (Department Of Public Business Relations).  Below is a copy of that email and in it they state that they will reach out to ARS and Home Depot.

Attorney General's Email:

The Florida Attorney General’s Office received your correspondence regarding the installation of an HVAC system by ARS/Rescue Rooter and your concerns with the insurance adjustment conducted by Home Depot. Attorney General Ashley Moody has asked that I respond.

We appreciate that you consider this office as a source of assistance. Pursuant to a complaint process our office has set up with both companies, I am forwarding your complaint to representatives of each company for review, and asking that the company respond to you and our office on the outcome of its review. I note that you have previously contacted the Florida Department of Business and Professional Regulations (DBPR), the regulatory authority that oversees air conditioning and heating contractors in Florida and also your local county government concerning these issues. We encourage you to continue working with those offices, especially if there are any new or ongoing issues.

We look forward to hearing from ARS/Rescue Rooter and Home Depot soon. Thank you for contacting Attorney General Moody’s office.

Sincerely,

ARS/Rescue Rooter

That Is Just Super Fantastic!

It is Saturday (day 212) of our HVAC installation and just the day to day stress chasing down or fixing this mess has been incredible.  On top of Corona Virus and Quarantine, we have to deal with mold and ARS!  We are hoping that this latest action will encourage Home Depot and ARS Rescue Rooter to do the right thing.  To date neither has honored the sale, installation or insurance the right (legal) way!

Well We Thought That Was Just Super Fantastic!

Looks like Home Depot is playing even more games!  Home Depot has released a response, but first here is the Attorney Generals response to me about the response of Home Depot and ARS Rescue Rooter.
